Uncle refused to fulfill his part of the oral agreement.What to do?

My father owned a piece of land in Kolkata and in this land my uncle from my mother's side convinced us to build a building on that plot at his expense and for which he would get 60% and we would get 40% of the total constructed area. Also all my flats which I am supposed to get will be completed by him as he is the promoter I.e he will ensure electricity, tiles, marbles including now he denies that and just handling the flats without the electrical wirings etc. How to approach this legally.

If there is an agreement in writing between your uncle and your father then only you can proceed legally against your uncle if he has not performed according to agreement. However if there is no agreement in writing between your father and uncle on what basis he has promoted the property.

Do you have any development agreement and power of attorney ? Is it authorised building? Have you made registration.of your flat? What documents.you. have? Oral agreement has no value.
