Token money paid to seller but seller denying registration

Sir three months back we brought 2 Acres land for 19 laks,we did sale agreement by giving 8laks and on DAT agri land 5laks bank loan dear,BT seller not paying and not agreeing us to pay DAT bank loan and not registering and not agreeing to refund our money,d stamp duty was 1900 we paid for sale ageement. So please suggest me sir
you have to file specific performance against the seller and you have to show you are ready to perform your part to register deed. for that you have to send legal notice stating that you are ready to perform. please contact with the agreement copy u entered i have to verify whether any condition clause is there.

sir, I gone through your question. If the sale agreement is registered or not, is not a question. you can approach again and ask him that subject to clearance the pending loan by you out of sale price, whether he is ready to execute sale deed. If he is ready, then, again has to one more agreement with him for concern to paying of loan amount. If, he is not agree for the same, then you can issue legal notice and demand for specific performance or returning of advance amount with interest and cost.
