To sell disputed property illegally acquired by brother

Want to sale disputed property which is illegally acquired by my brother. Court case is pending. According to papers it belongs to both (as it has both brothers name) but since more than 10 years he is illegally occupied it and denies entry and other economic benefits to me. I have not received single penny from him as rent or through any other way. Plz suggest what should I do ? And how should I do it? Religion- hindu
Even a case is going on, you have right of your share in the property. In case the court has ordered a stay on selling your share of the property then only you need to approach the court. otherwise you can sell your share

As you are saying that the suit in pending in the court, you would have demanded the relief i.e. compensation/ damages,Legally You can not sale the property as there is no possession and suit is pending.

You can file partition suit against your brother and in said suit you can ask mesne profit that means share of income from property.
And you also ask undisputed possession in said suit from your brother.
