Stay on construction no legal division done what to do

my grandmother owns property of 1800 sqft. She has two son's and one daughter. One of my uncle has started construction with out permission. My grandmother wants to divide plot in 3 parts each. What can my mother do as he has started construction in our share or land. There has been no legal dividation among these three. pls guide.
You grandmother can file a complaint in the nearest police station regarding the trespass. Also, your grandmother will have to file a suit for injunction on the construction, in the jurisdictional civil court.
