Son trying to misguide mother and wants to get the property. Remedy?

My mother is residing in faridabad is legal hire of property and had written will in 2009 registered in Delhi. she has mentioned that her house will be of her daughter and business will be of her 2 sons. Her elder son, by misguiding her that he is renting out one portion of property and for same registration has to be done in tehseel of faridabad and in trust she went out there and signed there without knowing anything. This happened on 7th August 2014, and it had been under property transfer in blood realtion . So we want to know what is remedy under same?

Dear Madam,

You need to know first what documents had your mother signed. You have to get the records from the sub registrar office.

After getting the records you can plan the further course.

Dear client , you can always challenge that act of fraud and undue influence commited on your mother . The registered will is a concrete document , any subsequent transaction of the same property will definitely raise eye brows in the eyes of law . You must immediately go for stay of the property , making a registered will a ground. I would personally advise apply for Stay as soon as possible , else there are strong chances your brother may sell any portion of the property without your knowledge .
