Sold property to 3rd party builder already sold it to MCD

08-Feb-2023 (In Property Law)

I have purchased Builder Floor (1st Floor) in Govt Approved DDA residential scheme of Rohini Sector-16 in Sep 2012. Same i sold in Aug 2015. But after getting registry done, new buyer informed me about property booking by MCD for Unauthorized construction. While going into depth, it was found that property was booked by MCD in Feb 2011 prior of my purchase and builder hide all MCD booking information. I have done nothing out of law. But new buyer is forcing me to get it clear from MCD. As i have purchased ok property and sold in same impression. What is my legal liability in this whole case.

If it was booked in 2011 for unauthorized construction it was your responsibility for carrying out due diligence before purchase. You can call upon ur builder seller for getting it cleared or book him for cheating....or else you will b held responsible

you have to file a writ before the High Court seeking a stay on the MCD booking as you being a bonafide purchaser. The LG has a scheme by which such properties are compounded. Also initiate criminal proceedings against the builder from whom you have bought the flat. Liability would remain on the previous seller only and cannot fall on your head
