Signed relinquishment deed in 1970 can she claim now

06-Apr-2023 (In Property Law)

My father Mr. A died in1968. That house no.65 in New Delhi was owned by him and the said house is built on the land leased out to him by L& DO. My three sisters executed relinquishment deeds dated jan 1970 and stated that they do not claim any right, title, interest or any share in the said house No.65 in New Delhi or the lessee rights in the said plot under the said house. It was executed in favour of of my mother Mrs.B and two bothers Shri C and Shri D. Since my sisters had relinquished their share in the said house No.65 in the year 1970,can the claim any share in the said house

It wholly depends on the fact that whether the relinquishment deed is registered or not, and if it is registered they might say that they were unaware about the consequences or they were forced to sign it and many more excuses they can take to fight for their right in the suit property. As per law they are legally entitle for their share in the property but once they relinquish their share. They cannot agitate for their share untill and unless it was taken by fraud. So in short if you are legal right, fight the case , sooner or later you will win. Best of luck.

Once they relinquish their right, they can not claim, but if relinquishment deed was executed under pressure or by fraud or by any other menace the validity of the relinquishment can be doubtful but in present case they relinquished their right in 1970 at this time they can not claim in property.
