Signature of granddaughter is mandatory for partition of the property
24-Jan-2023 (In Property Law)
Sir my mother grandfather has died. past 10 years ago. My mother grandfather has two daughter and 3 sons. My mothers grandfather has 1 acre agriculture land. My mothers grandfather get 1 acre from his father separately. Now family members are planning to split the 1 acre land into 5 split up for my mothers- mother and another four members. My question is My mother is eldest granddaughter for her grandfather. Whether signature of my mother is compulsary for their documentation. And whether they can make split up without my mother(Eldest Granddaughter) signature.
yes, definitely your mother have a valid, legal say in the documentation or else the documentation will not be a valid one.when the grand mother's property is being split up among the other living legal heirs then the consent of all the major legal heirs is just and necessary for valid documentation otherwise any one of the legal heir objected the split up then it would not be possible to split up the ancestral property. But please ensure that your mother name is in the legal heir certificate
