shop in grandfather's name father runs it can brothers ask for share
11-Feb-2023 (In Property Law)
My grandfather had inherited one shop & my father is running this shop since 1980s, but was it in my grandpa's name. My grandfather died in 2002. My father has continued. on my grandpa's death the registration of shop got cancelled. But still father continued without registration as there is some provision in AP- for turnover within limit we need not register. Now 3 brothers of my father are claiming share. My father has some self-employment loan certificate and grandpa had rent agreement showing my father has rented that place. Should my father has to give share? How to safeguard? Plz guide.
Your father can claim adverse possession of property since 1980 only. Now a shop is a business and if your brothers want a share of it, then they should have contributed to it . if not they have no rights whatsover.
