Seller not refunding token amount to buyer after cancelling the deal

i am the buyer and i had given token to the seller now due to certain circumstances i had cancelled the deal and the seller agreed to remit me the money as he will get the seller but now he has got another buyer now he is just delaying it is there any way out. there is no MOU between buyer and seller.

Dear Client,
If you do not have any agreement to the effect you cannot claim the money, however you can send him a legal notice and claim the amount by stating the sequence of events, also if possible try to get a cheque and a promissory note to the effect done.

The aforesaid facts do constitute an penal offence as well as civil wrong. You may file police complaint against him also issue a legal notice and upon failure to act upon you may initiate a penal prosecution as well civil suit against him
