Road sold by neighbor to a person using forged documents what can I do
12-Jun-2023 (In Property Law)
Our house is adjacent to DDA Land on which DDA has build flats, there is a house(property X) in our back whose entry is between DDA and Our house. DDA has tried to built boundary however the same was destroyed by the owner of the property X. DDA(Contractor) as an settlement left some land for the passage to the back house. The owner of property, sold the land making forged document to some one else claiming the passage as his own. Now the new owner has developed floors and trying to cover the passage and threatening us not to take any action. Kindly advice what options we have to stop this.
Well, if you are claiming the document is forged, then you should file a police complaint. For any action you want to take, I need to know how the passage affects any of your rights. If it does not, then you can do nothing, but if it is a common passage, then no one can cover it. If the owner insists on converting it, then you need to make a complaint to the DDA/NDMC and also file a case for injunction in the concerned court.
Please file a complaint before the office DDA and also intimate to the concerned Mcd office and also file a petition for seeking injunctions for rights of easement because it affect your easement right due to obstruction of sunlight air natural ventilation

Immidiately you should file a case for injunction with parmanent and mandatory relief. DDA will also be one party to the should. Once court granted injunction then he could not raise any construction on common area.
