Rights on mother's property after her death

02-May-2023 (In Property Law)

My dad and mom owned a property in equal share. My mom died intestate, leaving behind my dad, mom and sister. Unaware of d rule position as many of us, we hired a lawyer and he split moms share between me and my sister, which we relinquished to our dad, and he is the sole owner now. The lawer said there is no share of the husband (that is my dad) contrary to the rule and we believed him. Is this in order ? We are Hindu by religion.

The claim that the husband does not have a share in the property of the wife dying intestate is incorrect as according to Section 15 of the Hindu Succession Act the Husband will have an equal share as that of son and daughter in the property of the female dying intestate.
