I LIVE IN A FLAT AT A COOP GROUP HOUSING SOCIETY.. MY FATHER IS THE MAIN MEMBER AND I AM A JOINT MEMBER.MY BROTHER IS THE NOMINEE. NOW, AFTER MY FATHER'S DEATH WHO IS THE LEGAL HEIR OF THE PROPTERTY? WHAT ARE MY RIGHTS AS A JOINT MEMBER? WHAT ARE THE RIGHTS OF THE NOMINEE? THANKS,

Look if their is no will then property has to be partitioned .If property can not be divided then it has to be sold and sales proceds has to be divided among legal hair.How ever subject to verification of facts nominee can take refuge of the latest Supreme Court judgement which says property Right can be transferred to the nominee in group housing Society.I hope I have answered your question.

you and your brother both come in existence, your brother will be the main member as he replaces your father after his death being a nominee and you will stay as a joint member as you are.Therefore till your brother does not extinguishes your title as he is the main member .Please contact for further details thanks.

From your it seems that you want to know about the property in which you are a co owner and you want to know about the rights of yours as your brother is a nominee, here if you are a co owner of the property then 50% of the property will remain with you and in rest you will share will your brother 50% that means 75%
