Right on Father's self earned property
22-Aug-2023 (In Property Law)
My father has a house in his name bought in 2008.It is his self earned property. My father has expired in 2010.After 6 years, now, my uncle (father's brother) claims that he has a share in that house saying that my father had given half of that property to him. My father hasn't given him any property. My father has taken a debt of Rs.50,000 from his brother in 2005 and returned it back later, but my uncle didn’t give back the promissory note which my father & mother signed and gave while taking debt ,saying that it was lost. Can he do anything with that promissory note and claim my father’s house?
Hi
Since the loan was taken in the year 2005, your father's brother cannot claim the debt now.
More so since your father passed away in 2010, if at all your father's brother had to file a case against you as legal heirs, he should have done it by 2013.
Law of limitation will apply and your father's brother will lose the case.
your father's brother is making a false claim on your father's house.
