Right of illegitimate son on fathers self acquired property & benefits
13-Mar-2023 (In Property Law)
SIR, MY FATHER IS WORKING IN STATE GOVT EMPLOYEE MARRIED MY MOTHER HAVING TWO DAUGHTERS ME MY SISTER BOTH ARE MARRIED. MY FATHER IS HAVING ILLEGAL RELATIONSHIP WITH A LADY AND HAVING ONE SON AGED 21(UNEMPLOYEE). IN THE MEAN WHILE MY FATHER ADDED HIS NAME IN HIS SERVICE RECORDS AND PREPARED EHS CARD TO HIM. THE SAME HAS BEEN COMPLAINED TO CONCERNED AUTHORITIES BY MY MOTHER AND MY SISTER. GOVT ACTION IS ALSO ON PROCESS. MY QUESTION IS MY FATHER IS HAVING PROPERTY OWNED BY HIM. DOES HER SON(ILLEGAL) HAS ANY RIGHT ON MY FATHER PROPERTY AND FUTURE PENSION BENEFITS OF MY FATHER.
It depends on the nature of the property in question. If it is an ancestral property then the Illegitimate son can claim his share in the property but if the nature of the property in question is self acquired then it depends on your father as to whom he is going to transfer the property.
