27-Jun-2023 (In Property Law)
Dear sir,a property is registered in my name by my grandfather when I was very small. I have legal documents with me.my father and my step brother put a case in court demanding share from the property.currently the property is forcefully occupied by them.notice returned because I was away from home.the notice didn't come second time.is it possible that the court give the jugement in favor of my father and my step brother? please advise me . my religion is Hindu.thanks.
Yes it is quite possible because of the service of notice not being sufficient might have resulted in the case bring decreed ex parte. However it is advisable that you check up the exact status of the case from the court records and take necessary steps to recall the order and enter your appearance in the matter.
Is this property ancestral or self acquired?if this property ancestral then your father have right this property and second thing is that in case your step brother ,your brother is adopted or not.if the notice is return don't worry you go to court and verify your order.
