Relatives have been trespassing our property. I want to evict them
05-Sep-2023 (In Property Law)
Our relatives who have agricultural lands adjacent to my mother's lands are tresspassing into our lands, cutting down trees and throwing them in the middle of agricultural fields so that they may not be cultivable. How can we proceed legally against them? Should we go to police station and complaint or go to court and file a case? Please advise
: Firstly you can serve a legal notice to your relatives warning them not to trespass into your property. In case they still trespass then you can lodge a F.I.R. in police station for reporting the incident of trespass and for registration of case under section 425 for committing mischief and under section 441 for committing criminal trespass.
