Relatives fraudulently sold father's land after his death

30-Sep-2023 (In Property Law)
Dear Sir, I have a property, and after death of my father, my far relatives, took advantage of it, they have sold their property to a village peasant, which actually belongs to them. But the problem is, the seller has shown my land as his property and made him occupied my property. We were in such understanding till then that, the property is left vacant, as no one in our family is doing cultivation, after my father’s death,(we came to city for educational purpose). Later, we wanted to sell the property and came to know the fact that, my far relatives has sold their property and shown my property as that sold property. Now, we have told the buyer, to leave my land and occupy what he actually bought. We have obtained Injection order from court as well, but we don't have enough capability to tackle them, since, i am finding them intimidating and the property is in village (I can’t go every-time to look after that from Hyderabad). Please guide me what do I have to do? Myi

sir,
in the instance matter, since you were got Injection order from court , accordingly first you send a notice to the buyer and vacate property as per the court order , if required take help from the police. failing which you can file a petition in the court .

HI
Since you have the injunction orders in your favour, you should do the following
a) Apply to the village revenue officer for Demarcation of boundaries and have your property demarcated using boundary stones .
b) Once your property is demarcated by Revenue office, you can ask for protection orders from the court for your property till such time the dispute is settled.
c) If you can find a cultivator then you can handover the possession of your property to the cultivator who will then take care of your land.
d) There are agencies which provide security services (especially for people who have migrated to towns and are not in position to take care of vacant lands) who will then take care of such lands at a nominal fee(Rs3500 per acre/month).
Hope this helps
