Relative claims they need few cents in our property

12-Apr-2023 (In Property Law)
Sir, I would like to seek ur opinion on a issue.. My father had this land where our house is built.. it is the property of my grandfather. Our family is living there for 30 years.. Now I am planning to built a new house. So, we are planning to built wall around our home. We have 12 cents and it is in the will and it is documented. Suddenly when we are about to build, my relative living on one side claims that they have 10ft of land and they need it. But, there is nothng like that. It is a false claim. Now, he ia threatening that he will get stay order and will stop the construction. In such case, if they gets stay, the case will last long and I will be unable to build. How can I avoid this? After all I am building in my land. So, if they gets stay order even if if truth is in our end, we suffer. Is there something in our law respect to auch issues.

Dear Sir
You have to tell how many area is actually available in your plot. Exact Demarcation of the property is a must. Total area of your plot. South to North and East to West has to be given. Sketch / Drawing of the plot is required. If you r having the sketch of your plot. Then you can file a petition to your jurisdictional Tahsildar to get your site measured as per your document by paying necessary fee through govt Treasury . The surveyor will give notice to all parties around ur site will make their presence and measure the site as per the measurment mentioned in the document. Let ur neighbor be also directed to bring his document for his claim of 10 feet land at your site. Pls Verify. If he further disputes, u will get an injunction order through court of law to protect ur right and with police protection u will raise the wall within ur plot area.
