Regarding cancellation of Registered Sale agreement

Sir I have entered into a sale agreement with the buyer in the year 2012. Which is registered on a 100 rupees stamp paper .An advance of Rs.5 lakhs was paid. The remaining amt has to be paid by him with in 3months as per agreement. reminders were sent to him to cancel the agreement and take back his advance. He has acknowledged all my letters but not replied. Made personal visit to his house he is simply dragging and threatening. It is almost 5 years. How to cancell the agreement in Sub registrar office. His name is reflected in the EC. Pl suggest I'm already 66 years. Old.

Yes, You have to send a notice to him and ask him to take the amount back and have the sale agreement cancelled. if not he can initiate a case on you which may be problematic for you. hence you can hire a lawyer for the same.

I hope the validity of the Agreement is for 3 years. In your case there is registered agreement and you informed that you have visited them and requested them to cancel the agreement .Please issue a notice in writing to cancel the Agreement. It is already late.

Because there will be a clause in agreement in respect of the further payment. I hope even though it was later but issue a formal notice them to cancel the agreement. You also informed that he had received all the letters and not replied. It is the sufficient to show that your are done part of your duty in requesting for cancellation.
