Hi
suit will be barred by limitation as the transaction has to be challenged within 3 years.
ideally the transaction should have been challenged in the year 2008.
however it is surprising that the lower court has ignored the law of limitation
so will need to see on what grounds the lower court ignored the law of limitation

Sir,
The 'Law of Limitation' intends the time-limit for the suits within in the period, where an aggrieved one, can approach the court for justice. If they failed to meet the time-limit, is hit by the law of limitation.
In your case if the claimant have the significant reason for the long delay in approach the court, then basing on the strong reasons, court may be excluded.
