Purchase of property in Bangalore, now in dispute, what to do
24-Feb-2023 (In Property Law)
I am a resident of Mumbai. I had invested in a flat/property in Bangalore. Till date, our flat has not been registered with us. What's even more painful is that the ownership of has been given to some other person. I had hired a lawyer in Mumbai, to send them a Legal Notice in Jan 2017. But they haven’t paid any heed to it.
When you perchased the flat/in Bangalore and which document you have on that property? And you did any agreement on that property ? Here the clearly need to show al this things without see your documents we con't give you more information thank you
You have perhaps paid advance to the flat, and not got registered the same. As you seem to admit, some one else is in possession of the flat.
If the builder who sold the flat to you, you have a remedy against him.

A correct legal advice can be provided only after scrutiny of all related documents. The further action will largely depend on documents like Builder-Buyer Agreement, payment receipts, proof of allotment/sale of the same property to another party etc.
In your query you have not stated the date on which you have entered into an agreement with the builder and further as to whether or not you have paid the entire sale consideration.
Coming to the dispute at hand, you now have three remedies available to you. First, you could file a suit for specific performance of the agreement to sell, secondly, you could file a case before the consumer forum for deficient service and lastly you could file a criminal case for cheating.

Depending on what documents you have already executed with them, you can approach both the civil court and the consumer court.
If you have entered into an agreement to sell/paid sale consideration, and building agreement then those cab be pursued.
