Property partition rights. Please tell me how to proceed ?

My grandmother had a house , which came to my father after she died (no will). My father died in 2000, and it was transferred to my mother. Now my mother passed away (no will),we are 2 brothers and 3 sisters, 1 sister unmarried. 1. Is this property ancestral? 2.do daughters right to property now? 3.After my father passed away, should it have been transferred to my mother and all of us together? We are Hindu family.

You all children have equal rights in the property hence there is no will. Even otherwise you have not mentioned that how your grand mother has derived the property whether it is from her husband or her self acquired. In the absence of will you all siblings have equal rights in the property. Mean time documents has to be perused to see the inheritance.

sir, This is a good question. you stated that the property belonged to your grand mother. If she was the mother of your father and after death of your father this become the ancestral property. So, you are all successors to the property after death of your father and it should had been transferred in all of your names along with your mother. Now, there is no problem, you can get the katha along with your sisters. If you fight in court of law, the shares will be decided as per.
