Property is to be run by only 1 joint owner, what is the procedure

3 sisters (all married) are successors of their widow mother who died in Dec. 2016 in Mumbai leaving behind a residential flat in a co-operative housing Society at Juhu, Mumbai (worth Rs. 2 Crores approx) She did not make any WILL This flat was purchased by their father who died 20 years ago. In case, the flat is to be owned by one sister only, what are the options and procedures and what are the stamp duty payable.

As per Hindu succession act all three sisters have equal right over that property since no will is made by your mother and it is self acquired property. You need to apply for legal heir certificate from the court.

You have to apply for the letter of administration in the hc for the all the property left by the mother. Where in u can mention that 3 of u are entitled to the said flat ..there r no other legal heirs nd two sisters wants d flat to b transferred in the name of one sisters .nd there are releasing al their right title interest in the flat in favour of that sister.once Loa has been granted by court .sharecertificate is required to b transfered in her name.u hv to pay prescribed court fees for that.i hope dis ans ur query.
