Property in possession since 1985 can we take adverse possession
03-Feb-2023 (In Property Law)
Restected All we bought property in 1985. We have taken this property with loan(in cash) from Mr.X and title of property is in name of Mr.x. We have paid all money to Mr.X bt he is refusing to transfer name. We are in possesion of property from the day we bought it. We are paying all maintainanse from day1. Also there is no documents of possesion done beetween us. Now we would like to claim property by Adverse possetion law as there no leagal claim done By Mr.X of property. So can we use Adverse possesion law. If yes than how to approch.
You can claim the adverse possession..
You need to file civil suit in the court for appropriate reliefs and injunctions and declarations !
However, you will also need to protect your possession once you file the civil case
You also need to take care that the other side does not take help of criminals and take possession from you
so, you need to plan very very well for all the things in civil court and then take the step of filing the civil suit and take stay order in your favour from the court
Hope this helps
