Property in fathers name how will it get divided in 3 equal parts

my father had built a house.8 years back he passed away.now my elder brother wants entire property to sell of.property is still in late father's name.my brother is harassing my mother to sign paper to transfer the property to him.he has also declared that only 1/5 th share he will give if he feels.I want entire property to be divided to 3 members brother,mother,me.kindly suggest
