Firstly, Can you specify what kind of an agreement had you entered?

Secondly, it is difficult to respond to your queries without seeing the papers filed by the builder and the papers that you actually have to falsify his claim.

Appear in court in person and tell the court you have the documents but your lawyer has not been filing them. Ask the court to allow you to appoint a fresh lawyer so he can handle the case. This is your best option.

Before the next date of hearing appoint some reliable and professional lawyer. Through that lawyer make your submissions before the court that previous lawyer has not filed any document and you may be given the last opportunity to present your case.

Discuss with your lawyer all the terms you had in Agreement between you and builder (your query is not clear on what conditions are their in agreement) so that proper case can be made before the court to get you relief on the next date of hearing.
