Property dispute with uncle he want to remove us property what to do
21-Sep-2023 (In Property Law)
My paternal uncle has sent a court notice to us to vacate a house that has been given to him by my grandmother in her will she made 7 days before her death. This house has been occupied by us for 30 years now and was in my grandmother’s name with power of attorney in my uncle’s name. He has now sent this notice citing the will in 2014 (while she died in 2007). He is doing so to blackmail us so that we take the forgery case against him back as he had sold my fathers property by forging documents after my fathers death. He is almost proven guilty with the case in final stage. The property tax and association fees are in my mothers name while the electricity bills are in name of the original owner (not my grandmother/ uncle). How fair are chances that he will be able to win this case. I am a Hindu.
File case of permanent imjunction against ur uncle if ur in possession u do not need to worry legal nptice has no legal binding on urself let him go and file a title suit for possession but u need to file imjunction case
Send full facts and documents including copy of the case which has filed and ur response to the same. You can do so by email which you can get from this site. I will advise you after going through the same.
We need some more details from you like the ownership papers and have to see the notice received by you in case this property was owned by your grandmother and she executed WILL that means that you became rightful owner after her death therefore detailed discussion is mandatory before proceeding further.
