Property dispute between brothers can court seal property and decide

06-Jul-2023 (In Property Law)
Some years back my dad and uncle decided to renovate full ancestral house. From house with tiles to 1 floor with slab. Now after so many years there grew a spat between two brothers and its still growing . But They continue to share same house. House is yet to transfered on my grandfathers name . Case is under proceedings. Topic of pain for me is Spat between my dad n uncle . Anything can happen behind me as my dad or mom is alone home with uncle n fly sharing same home. By any means can full proprty be sealed and let court decide instead of two brothers quarreling?

Taking into consideration the above facts. One may file partition suit with the courts and thereafter the issues may be settled between the aggrieved parties.
However to determine the specific action . One need to throughly examine the legal documents regarding the issue.

The settled law is that if some purchaser has bought the portion of a coparcener in the ancestral property he cannot compel him to file a suit for partition; it is the choice of the coparcener to decide as to when he would like to put an end to the status of the jointness and be separate in property. The settled law is that if some purchaser has bought the portion of a coparcener in the ancestral property he cannot compel him to file a suit for partition; it is the choice of the coparcener to decide as to when he would like to put an end to the status of the jointness and be separate in property.
