Property case going on from past 35years, how can ownership be claimed
30-Jul-2023 (In Property Law)
In the year 1985; we moved into a very small house in Mumbai measuring approximately 81 sq fts through Power of Attorney from the person who was already staying inside it. During that time this complete building belonged to a lady who left everything and went abroad after which she died. Now initially all the members of the building told us that when the society would be formed they will include us as well but at the last moment they denied taking us and files a case in the court stating that we are staying illegally. The court of small cause dismissed the petition stating that "Appeal stands dismissed with No order so as to No cost" after which we moved onto the Bombay High Court. In the Bombay High Court after 16 years of hearing now all of a sudden the oppenent advocate that shown a Death Certificate in the court stating that the person whose Power of Attorney we had had expired. Please let us know what decision would the court be conclusive of. It has been around 35+ years.
