Hi, The tenant paying very least amount to the property owner and they not vacating the property.What is the procedure to vacate them from the property immediately - Dear Sir, You may file fixation of fair rent case against the tenant, or Request him to vacate for your own use subject to some conditions to be fulfilled as per law.

The Land lord and tenants in Tamil Nadu are governed by Tamil Nadu Buildings (Lease and Rent Control) Act, 1960. Your problem can only be solved on seeing the modalities and duration of your tenant stay in your premises. You can file a petition for vacating or a fair rent from the tenant. The fair rent petition can be filed for seeking a reasonable rent on seeing the market value of the property in your surrounding and the amount of rent paid by your neighbours. On failing to pay a fair rent you can vacate the tenant with a court order.
