I have a flat currently on my mother's and wife's name. Myself and my wife are both NRI (US citizen). For a gift deed to transfer the ownership from my mother's name to my name, does my wife also need to be present in person for registration and other formalities? The flat is located in Navi Mumbai. Thanks.
AGift deed is a legal document that describes voluntary transfer of gift from donor ( owner of property) to donee (receiver of gift ) without any exchange of money. Registering a gift deed with the subregistrar is mandatory, as per sec. 17 of the Registration Act 1908. yuor mother can gift her share in the property to u. your wife is not require for gift of the share of your mother.
