Possession Delay 4 Years,and asking more money As Escalation charges.

We have booked a unit in Noida Sec-74,Supertech Capetown,the builder delayed possesion 4 years,now they are ready to give possesion but asking 2 Lakh more for Escalation charges,Kindly guide what i can do for this.

The builder can not ask for any additional charges after the registration of the sale deed. Also, if the builder is doing so, then you can file a complaint in the consumer forum against the builder after sending a legal notice for the same. Now, if the builder denies to comply with the said legal notice then, you can file a complaint against the builder for deficiency in services, under section 2(g) of the Consumer Protection Act.

There is no need as such to give builder the escalation charges, if the possession has been delayed due to the fault of the builder then you are not liable to pay escalation charges. You can file a case against them after sending them a legal notice with regards to the same.
