Partitioning of property after demise of father according to HUF

Sir, We are two brothers .My father passed away in 2013 leaving behind my mother and two sons. Now my mother wants to distribute the property between two brothers and she doesn't want any share in between. What are the legal procedure to process the same. What would be the financial implications for that. We are hindu by religion. Thanks.

You may go for a deed of partition to divide and demarc your father's property among yourselves. But make sure that the deed of partition is registered. At present this is what you can do for dividing and demarcating your father's property.

there are various ways to relinquishment of share one is having and same could not be elaborate in few lines. This could be advised after going through the papers and the related document whereby it appears that your father was the owner of the property which he left behind . Hence you have to consult with advocate of your choice and trust who may give you proper guidance in the matter.
