Partition of ancestral property uncle refusing for division what to do

My father has an ancestral property , he want to divide it but my uncle refusing Also my uncle had sold some part of land by fake signature of my father without intimating my father Further he also built a flat on unpartationed land Now what legal action can we take....? Please advice all legal procedure in details
We suggest that your father should file a suit for partition thereby seeking his share in the property.
Further in the said suit itself he should specify that the signature were forged. Also file an application for temporary injunction thereby seeking stay on the construction on the said property.
In addition , your mother in law should file a police complaint under Section 420 of IPC.
