Parents expired how to register ancestral property in our name

i m having a ancestral property ..and we are 3 brothers our parents are no more.. how can we register that property in our name in 3 parts ..what is the legal procedure

Simple- Make an application addrssing to the concerned officer in Revenue Office of your local area mentioning the fact of death, and total children of your parents including females, and pray to update the record as per inheritance, attach the death certificate with that. Mention the properties also.

Mutation of the title of the property is required to be done with the office of the Sub-Registrar in your area by submitting the relevant documents like death certificate, original documents of title, undertaking regarding will etc.

Is there any will left by your parents .. by the last one who died. If so it has to be probated. If not then with consent of all your brothers and sisters it can be mutually divided in three parts and a mutual partition deed can be executed signed by all of you, thereafter property can be mutated in all three name equally or the share which you divide among yourselves. If all of you don't agree then it has to be partitioned through court by filing suit.

According to Mitakshara, the son has a right, by birth both in his father’s and grandfather’s estate but as has been jointed out before. a distinction is made in this respect by Mitakshara itself. In the ancestral or grand father’s property in the hands of the father, the son has equal rights with his father. The property of a male Hindu dying intestate shall devolve firstly, upon the heirs, being the relatives specified in class 1 of the Schedule and secondly, if there is no heir of Class I, then upon the heirs, being the relatives specified in class II of the Schedule. Among the heirs specified in the Schedule, those in class I shall take simultaneously and to the exclusion of all other heirs, those in the first entry in class II shall be preferred to those in the second entry, those in the second entry shall be preferred to those in the third entry, and so on in succession. Firstly take death certificate and produce it in concern department as well as contact to lawyer.

To register the property there are different ways?What sort of property is it?? Is it a residential or agricultural land??If it is a residential then after taking the death certificate an application stating the legal heirs for mutation in MCD has to be moved.Therefore if its a agricultural land move to the Revenue Department of your area.
