Paid extra amount for my property but provided with less area

THE PHYSICAL FLAT AREA IS 440 SQ FT CARPET . I AM IN POSSESSION SINCE LAST 34 YEARS IN BORIVALI MUMBAI NO EXTENTION/ALTERNATION MADE BY ME THE APPROVED PLAN SHOWS MY AREA AS 423 SQ FT. CARPET THE SOCIETY/DEVELOPER SAY THAT YOUR FLAT AREA WILL BE CONSIDERED AS 423 SQ FT ONLY AS AS PER TERMS OF TENDER APPROVED PLAN AREA WILL BE CONSIDERED. HOWEVER I HAVE PAID FOR THESE 17 SQ FT AS I WAS TOLD THAT THESE FLAT AREA IS BIGGER AND I PAID FOR THAT. PL ADVISE I CAN GET COMPENSATION FOR THESE 17 SQ FT OR FORGET IF YES HOW MUCH EXPENSES. THANKS

Yes you may claim for fraud & ask compensation. But major problem is 34 yrs of purchase & possession. You are advised to generate report verification for certified Engineer to prove you knew recently.

after 34 years your complaining. you are barred by the limitation act. Had this been an issue, you should have prior itself at the time of taking possession of the flat , made a complaint against the builder.
