Owner not ready to give the refund back what to do.

there is a one case related to property. On Dec 2013 we agreed to buy one house at Varanasi @ 68 Lakhs and we gave him 22.50 Lakhs as advance with notarized agreement. After 15 days we came to know he belongs to SC/ST category and property also having some problem. We requested him to return the money but he is not ready to return the money as he invested somewhere else. We filed one case at high court Allahabad on 2014 but now case is dismissed with state that is the function of the Trial Magistrate. Now, we dont have any choice so, we are ready to take his house but he is neither ready to refund the amount with interest or sale house. please advice how to way forward. Info : we are belongs to OBC category.
If the High Court has dismissed your Petition you have the opportunity to prefer a Special Leave Petition before the Hon'ble Supreme Court of India. You can challenge the said Order under Article 136 of the constitution.
