Neighbor threatening with self written demolition notice

23-Sep-2023 (In Property Law)
We have a own house which was constructed 35 years back as per the legal documentation of the property. Our neighbour bought the land 30 years back and disputed with us claiming that we took 2 extra feet of land. He was actually cheated by the owner of the property who has provided wrong measurements in the documents papers. After we showed our papers, the neighbour began construction of his house in his land 25 years back and all was well until a few days back. He has sent a self written document "demolition notice" and is threatening us that he will take back the 2 feet of land. I would like to know how we can move this legally and should we proceed to a police complaint saying he is threatening us? As my parents (who are both over 60 now) stay there, we dont want too much issues to be created but would like to know hoe we can shut up for all this threats.

If your neighbor has issued a notice it has to be replied properly and a suit for injunction is advisable. Since the matter is of civil nature police can't do much about it unless your neighbor trespasses into your property.

Firstly he is no body in law to issue to you a ‘demolition notice’.
Lodge a criminal complaint in the police station and turn it into a FIR. Seek protection of your parents. The FIR will be sent to the Magistrate Court and a case will be registered against your neighbor.
If he does not budge and/or if the complaint is not turned into a FIR, move the court. You can choose between turning this into a civil suit or a criminal suit or both.
