Your friend can lodge a criminal complaint against the concerned land lord..and the only way to stop the bank is to repay the loan amount otherwise there's no remedy..your friend can approach the high court for fixing easy instalments to repay that loan..your friend needs to contact the bank for a solution else high court is the last option if negotiation with the bank fails.

The land was mortgaged to bank before it was purchased by your friend from this owner. He possibly would not have shown the updated mutation documents and hence your friend was not able to figure out the cheating. He further colonised on this land, which seems to be an unauthorised colony. He should apply for a stay on such auction and should figure out a way with the bank to return the money. Meanwhile he should also file a criminal complaint of cheating and fraud on the person who sold the land to him.

bank is authorise to take possession of the property and can also sell it. you try to clear bank dues and try to communicate with the bank and give it a better offer and show them furture profits.

file FIR against the landlord who disappeared.
