Need advise on Property possession

Hi, I am Naganath, My sister's Land is in Telangana. My Sister and Brother-in-law both passed away ~5 years ago. My sister has two daughters of age Elder: 14 years and Younger: 12 years. Both girls are staying with us since last 5 years (my parents taking care of them and we staying in Karnataka which is border place to Telangana). One acre of agriculture land is made/registered on my niece name (elder girl name). But my Brother-in-law family not giving us that property. Whenever we ask for property hand-over, they are giving excuses and now they are fighting with us, saying it's their property and they will not give. We requested them to take care of girls in that case, but they are not ready for that also. Kindly help me what we need to do to get that property possession/handover to save that property for my niece(for their education, for their future). Regards, Naganath

Madam,
In your case you informed that the property was registered in the name of your niece. She was minor and i hope at the time of sale deed registration some other person or next friend of the child sign the deed. In case if it was registered in his name, then that niece will be the absolute owner of the property. when she come to the age of majority.

Here if there is dispute, some other person who is the next friend, can file a case for possession over the property and take injunction from alienating the said property. Please proceed immediately.

sir, you stated that the land has been registered in the name of elder girl. so, she is the absolute owner of the property. she got right to file a suit for maintenance against their uncles and maintain their education expenses. or you can seek permission to sell the property
