In the State of Tamil Nadu, to change a misspelt name in registered property documents, you can follow the below steps:

  1. Obtain a certified copy of the property documents in which your name is misspelt.

  2. Prepare an affidavit stating that your name has been incorrectly spelled in the property documents, and provide the correct spelling of your name.

  3. Get the affidavit notarized by a notary public.

  4. Obtain a stamped paper of Rs. 20 from the notary.

  5. Submit the affidavit, certified copy of the property documents to the Sub-Registrar's office where the property is registered.

  6. Pay the prescribed fee and obtain a certified copy of the corrected property documents.

It is important to note that the procedure for correcting the misspelt name in property documents may change from time to time. Therefore, it is advisable to consult a local lawyer or seek guidance from the Sub-Registrar's office for the correct procedure to follow in your area.

Dear Madam,

It happens sometimes during documentation, This can be rectified by a rectification deed singed by the Vendor, if the vendor is alive. Another option is please make a declaration affidavit that A. Meenakshi and O.Meena is one and the same.

Whether your mother mutated the revenue records on her name after purchasing the said property?, if so what was the name to which it was mutated? While posting a question it becomes your duty to give proper details so that you will get a proper opinion and suggestion to carry out further tasks in this regard.

However since a rectification deed is not possible at this belated stage, you may try other measure/steps to rectify the mistake, i.e. by creating an affidavit duly notarised stating that both the names belong to one and the same person and that the name found in the sale deed document is an error which occurred due to over sight and this document may be attached to the original sale deed while disposing or transferring the property from her name to any other person.
She can execute a registered gift or settlement deed in favor of you both subsequently.

Affidavit submission: Have a notary prepare an affidavit for the name-change, which will include the current name, new name, address, and the reason for the change (could involve marriage, astrology etc.). The affidavit must be signed by at least two people of Gazette Officer rank.
