My uncle is asking for a share in my fathers property what to do.

26-Dec-2023 (In Property Law)
My father have purchased a plot in jharkhand from a person which is not related to my family .Now my uncle(fathers younger brother) have demanded the partition from that land which my father had purchased with his own money in 1986 but there is no such proof of money because at that time people save money in their home not in a bank .So is there any law by which my uncle take land which is in the name of my father and now he is threating to sue in court . The reason he is sue to court that he is minor at that time and my father had take money from my grandfather to purchase that land .So what is the solution ,is there any means by which he take land from my father or what happened in court if he sued me with the above reason.

Dear questioner,
You have raised issues regarding demand of shares of younger uncle in the property which was purchased by your father is maintenance in the eye of law or not. As per the above query I would to inform you that if property has been purchased by your father which is self acquired properly then no one can claim over that property except you and if uncle is having plea of minor during the time of buying property in that situation onus is on younger uncle to prove the facts that such property is ancestral property which would be difficult for your uncle. If you can proof that your father had purchased such property then no need to worry about case. Feel free to contact me for more assistance.

If your version is correct and the same can be proved, technically he would not be able to prove his case in the court. filing case against a person and winning a case are two different aspects. Be cautious with the paper work.

If the registered sale deed is in the name of your father then there is no chance that any one can the property purchased by your father so there's nothing to worry about and no partition can be claimed either
