My Husbands share in my father-in-law's property.

20-Sep-2023 (In Property Law)

My father-in-law got the whole house and property as a Gift Deed from his mother.(Ancestral Property) He has started selling away the property part by part (and dealing in raw cash without bank transactions). Can my husband (Eldest son of my father-in-law) claim any part of the money from the sale of the property? My father-in-law is denying any disbursement of share in the property or the money received through selling any part of the property with his son(my husband).

First of all we will have to examine the papers and complete facts to ascertain whether the property was ancestral or not, also your facts do not state  whose ancestral property was it.

Further, your husband can challenge the gift deed and also file a suit of partition in the said ancesteral property thereby seeking his share in the property.

are you leaving in a shared household with your father in law? if so you perhaps can establish certain rights. otherwise you do not have any direct claim on the property of your father in law. contact with all the papers, perhaps so good advise can be given after evaluating with the fact and circumstances of the case
