my father's brother refusing to partition divide the land to my father

my grandfather was having land (cheluka bhoomi) of 5 acers in a village from around 1965, he has 2 sons. elder one is staying in village. younger one is staying in town(hyderabad). i am son of younger one. In 1979 my grandfather died. now my father brother is refusing to divide/partition the land to my father. present pahanis are showing my father brother as pattadhar. actually he has not purchased that land from any body it is purely transfered from my grand father. Records from 1963 to 1984 are not available w.r.t the land survey no.s in MRO office, how to proceed to sue.

We suggest you should file a suit for partition thereby seeking your share. Alongwith you file application for temporary injunction so that your uncle cannot transfer or create third party transfer.

Further regarding records you file RTI and seek records from the department
