My Aunt is asking for her share in grandfathers property what to do.

My Father Sister is Asking for Right in Property of My Grand Father. My Grand Father Died in 1982 She also sign relinquishment deed in favour of my father. what happen if go in court for her right in property.

If she has already relinquished then she cannot ask for her share
But i need to see documents if the property and relinquishment deed only then some definate opinion can be given. You may meet me after fixing oppointment

As the rule of law if any person relinquish has property as well as a share in the name of other person then nobody can claim any right which was vested in that property before the time of relinquishment that's why it is my opinion that nobody can claim right over the property after relinquishment well as the matter is concerned I also suggest you to meet local advocate with proper details

By executing relinquishment deed she has given her share in favour of your father hence she has no right to claim her share from your father. She can go to court alleging that relinquishment was done under force, pressure, fraud etc. and she must seek cancellation of the same .Thereafter she may get her share if same is cancelled by court.

The Relinquishment deed if registered can not be revoked ,Therefore if she has done so then its right of your father in the said property.Even if she moves to court there also she can not challenge the registered deed but if unregistered then definitely some lakuna can be pointed out.Therefore going and approaching court of law is matter of right but the factual situation and evidence always counts.

If the relinquishment deed has been registered, then your aunt has no right in the property. Otherwise she has a limited right in the property of your grand father. However, you should be prepared for the case.
