My ancestral property in trichur

This is regarding ancestral property is taken away by father's younger brother but will is with us but father is no more he had demolish old house which was built by father. Currently he built a house and living there.can we claim the property .Because my mother is also old unable to settle. Can you suggest how to proceed
You will have to obtain a legal heir certificate/succession certificate from the registrar's office, after that you will have apply for the probate of will in the jurisdictional civil court. Also, you can file a suit for partition in the same court as well.
