Mutation after father's death what is the procedure and time taken

21-Nov-2023 (In Property Law)
Hired senior lawyer for transferring house in my name after my father's death. Registered will is in my name. Mother expired 8 years ago. Sister is married. Have provided Xerox copy of Registered Will, House registry, death certificates, house and water tax etc. to that lawyer. He has taken Rs.X in advance and now is telling new dates each time I approach him. He has not taken my signature on any application or affidavit or bond and still claiming that work is going on and current status is publication has been done. I am bit worried whether he can do any forgery using Xerox copy of my docs. How many days it takes to complete this process and what is correct procedure. How to tackle this senior lawyer.

You can ask for the case number and details for the said property and get it checked in the concerned court. Some of the courts have the e-courts in which you can see the case status. The time taken for this is usually 6 months or more depending on various factors like presence of Presiding officer (Judge), bycotts/strikes and more. You can speak to your advocate for the order sheet of the case.

you need to exercise due caution in any transaction. although a senior lawyer will never harm the interests of his client. but you should try to know the progress of your case. the number of days taken depends upon case to case basis.
