Mother in law and husband are co-owner but she has posession

Hi, my mother in law and my husband are the co owner of a flat. Husband is paying the emi of it. Now, his mother is not letting us enter the flat and she has put tenants without our consent. Pls advice what to do. We r a Hindu family.

If your husband and his mother are co-owner then she cannot deny your entry and use and occupation. Besides tenant is to be put in with the consent of both the parties. Your husband is entitled to recover half of the rent.
Your husband should first serve a legal notice through a lawyer and then file suit. For details you may contact me.

will glad to help you. If your mother in law and your husband is co owner then you can file a suit for partition of the aforesaid property. Your mother in law has no right to take over the property.
