Money lenders occupied my late father's property

There is one house of my late father in Bihar which is illegally occupied by the money lender. My elder brother took loan on the my late father house property and unfortunately my elder brother also went to jail. Taking advantage of this money lender deliberately illegally occupied my late father house. But not my late father and elder brother who is presently in jail have not executed sale deed the house to the money lender it is just we executed loan agreement with the money lender. I have decided as the legal heir of the property I will file "writ petition" in the High court for eviction

If your brother has not mortgaged the property to get loan from the money lender then the money lender cannot recover the due amount by your house and you can file a suit for eviction.
